On March 23, 2018, President Donald Trump signed into law the Clarifying Overseas Use of Data (CLOUD) Act, which modifies the Stored Communications Act (SCA) to permit U.S. law enforcement to compel the disclosure of certain customer data located in foreign countries. Although Senator Orrin Hatch introduced similar bills in attempting to amend the SCA in previous sessions, the CLOUD Act was widely perceived as a response to oral arguments in United States v. Microsoft, argued before the Supreme Court earlier this spring. This teleforum will provide an overview and analysis of the CLOUD Act.
